Omaha, NE asked in Divorce and Real Estate Law for Michigan

Q: Ex wife and new husband live in home but I remain on the mortgage. How can I be removed from that mortgage?

I have requested since 2007 that they refinance home without me being envolved. I have paid and removed all liens on the home as well.

A: Without seeing your judgment of divorce it is going to be hard to answer this question usefully. You should seek out a local divorce / real estate attorney to determine what you need to do to get things enforced. WORSE case scenario, you may need to go back to the divorce court to clarify the judgment and that MAY not be possible!

Seek local legal help ASAP. Many attorneys offer no or low cost initial consultations, or it may be best to go back to the attorney who handled your divorce in the first place since he or she will likely not to be brought 'up to speed' as a stranger to the case would need to do!
