Q: Separating from my child's father never married Can I ask for full custody in exchange for himnot paying child support?

I don't want to keep him from her but he has a history of depression and anxiety and has disappeared and told me several times he just wants to run away when things get tough. My fear is that he will disappear and reappear demanding his rights. I want him to see her as much as he can but not be able to make her life unstable. Can I offer him no obligation of child support in exchange of full custody?

A: Those are separate issues: child support and full custody. However, in my experience, an agreement between the parents that promotes the best interests of the child will be accepted by the court. This sounds like a good situation to retain an attorney as you do not want to have the appearance of using one issue (child support) for another. Your lawyer will be able to talk to you about what is in the best interest of the child and present it in a fair way to the court.
