Q: My husband was not notified but found out he has been assigned an attorney for his WC case by the carrier.
Should he contact his employer for the attorney's contact information? Why would an attorney be assigned to a Workers Comp case?
A:
It sounds like the insurance company has referred their case to their attorney. Most likely the new attorney will evaluate the claim and make their recommendations to the insurance adjuster. The recommendation could be to accept the case and pay for medical and lost wages, or to challenge the case on any basis.
If the adjuster has an attorney than your husband is most likely going to be at a great disadvantage and not on a level playing field. Claimant's attorneys (attorneys for the injured worker) do not charge an upfront fee and will provide free consultations. You best bet is to call and get a consultation so the full picture can be explained.

A: The carrier would not assign an attorney for him. The would hire an attorney to represent their interests, not his. He should immediately consult with an experienced worker's compensation attorney.
A: He should at least contact a member of the NY State Trial Lawyers Assn who focuses their practice on workers compensation. They give free consults!
