Palmdale, CA asked in Small Claims and Car Accidents for California

Q: I have a question. I just need to know what I can be entitled to with regard to compensation with regard to a TC

I had some work done on my vehicle about six months before it was in a car accident. The person who hit me didn't have insurance. I had insurance but only liability. My insurance company told me I could take sue the other person in small claims court because I only had liability insurance. I just need to know what I can get from him with regard to a legal stand point and take care of in small claims court. I had to purchase a newer/used car with financing. What am I able to sue the person for with regard to a reasonable compensation for my loss? I know I have to do it through small claims, but I just need to know if I can sue him for the loss of the stuff I put into the car with regard to the loss of the vehicle or the price of the newer/used vehicle I am now purchasing because of the accident.

A: You can sue for actual, consequential and incidental damages caused by the defendant. If you have personal injury though, you may want to consider suing in superior court so you can also sue for pain and suffering.
