Nesconset, NY asked in Civil Litigation for New York

Q: Can I press charges on someone who refuses to give info. (name of bank & give me death certificate) on a cd account that

was left for me by my mother upon her passing who passed away on 9/16. I can not afford an attorney, trying to

obtain probono from the appropriate associations without any success. Can you assist me in finding a probono

attorney or can I bring these people to court on my own with a court appointed attorney ?

I am not sure of the practice area, Civil Litigation ?

A: This depends on what county you live in. You will likely not be appointed and 18 B attorney by the court, as this is a relatively simple thing for us to do, and in general requires only about an hour of work ( our firm bills $120 an hour on this sort of case).

You must also make note that UNLESS you were designated specifically as the beneficiary on the CD, or you were named as the beneficiary of the CD in your mother's will, and the contents of said Cee D will be distributed with the rest of your mothers assets "intestate", meaning your mother had not disginated anyone as beneficiary for the CD. In that case it would go to your mothers parents first, and if they are deceased, her children "per sterpies" meaning equally among her children.
