Indio, CA asked in Child Custody and Family Law for California

Q: Can dad take child even after he told me I can keep him his weekend?

I asked my sons dad if I can keep him on his weekend because he's been sick and he said it was fine, that he'll take him when he has to go with him again and now it's the next day and he texted me that he wants him now

A: If there is a court order, the court order would be the controlling factor. Although the dad said you can have the child for the weekend since he was sick, he will probably say he's feeling better. If it's his weekend on the court order, it doesn't sound like much can be done. More facts are required to provide a thorough analysis. If you don't have any court orders, filing for child custody and visitation to obtain court orders may be the appropriate course of action. Many family lawyers offer a free initial consultation that you should take advantage of.

A: What does the court order re: custody/ visits say? More details are necessary to provide a professional analysis of your issue. The best first step is an Initial Consultation with an Attorney.
