Alhambra, CA asked in Consumer Law and Contracts for California

Q: Can I ask a salesperson from car dealer in California to sign a contract I created stating the car has clean title?

I am buying a car in California from a dealership and can I ask a salesperson or a manager to sign a contract I created for the car I am going to buy; stating that the car has clean title (as the dealer claimed) and if the car was later found with untrue title, the dealership will take full responsibility that affiliate with the false title and will refund full price of the car that I bought from the dealership? Thanks!!!

A: You can propose that, but you may find the dealer unwilling to sign such a contract that you draft. You may simply want to contact DMV and present them with the VIN number to check the title of the car. More details are necessary to provide a professional analysis of your issue. The best first step is an Initial Consultation with an Attorney. A: If you bought a car from a dealership with a false title, it wouldn't appear to be necessary to have a "contract" as you describe. It's obvious that the dealership would have sold you something that it wasn't supposed to and that you would have a potential lawsuit for the value of the purchase price.
