Q: Did my employer discriminate against me because I'm pregnant?
I think my employer discriminated against me because I'm pregnant. I had told my employer since I started almost 2 years ago that I wanted to become a manager one day. She fully supported this and I climbed the ladder to an assistant manager within a year. Finally an opportunity came for a manager position and she offered it to the other assistant manager, who has never openly expressed interest in this position and consistently called customers rude names to their faces. When I asked my manager why I was not considered she told me that because I was "pregnant and hormonal that I was not ready and corporate would not want to promote someone they would have to temporarily replace and would rather hire someone that would not need maternity leave." The next day I asked again for proof and she said it was her "opinion" but I could not get a recommendation unless it came from her.
A: If your employer has at least 15 employees, then yes it appears the Pregnancy Discrimination Act has been violated. The attorneys on here are prohibited from soliciting you to retain them, but if your employer has at least 15 employees you should contact an experienced employment attorney immediately. Also, If your employer has 50 or more employees, then your maternity leave would be covered by the FMLA and you might have an FMLA claim as well.
