Santa Clara, CA asked in Family Law and Small Claims for California

Q: Relative wants money back that has already been spent?

A relative gave me $120 to purchase souvenirs for them while i was abroad in Europe. I spent the money and bought their things, but haven't had the time to get it to them because I don't see them often and currently aren't on the best terms due to other family issues. I have not intentionally kept it from them, I've forgotten to bring them along with me when we do happen to cross paths. She is now asking for her money back even though it's already been spent. I told her I have her gifts and will bring them to her but she refuses and wants cash that is already spent, making it money from my pocket. She has threatened to take legal action if I don't return her money. Do I have to give her the money if I already spent it on her souvenirs? The souvenirs are useless to me as I bought them specifically for her and her family and I can't fly back to Europe to return.

A: Box up everything you bought and have it delivered to her. Include the receipts if you have them. Just fulfill what you promised to do and stop coming up with excuses.
