He hasn't been served. What should I do now
A: Get him served. File a Request for Order for interim (temporary) emergency custody orders. Hire an attorney.

A: You probably need to file a request for order for child custody and visitation. Filing ex parte may be necessary, the court may not find it as an emergency depending on the specific facts. The dad will need to be served and you should contact a local process server to see if he or she knows anyone in Florida to serve him. You can also do an internet search for registered process servers in Florida. If you have not filed a request for order for child custody and visitation, you may want to serve him that at the same time so he doesn't try to evade service, etc. More facts are required to provide a thorough analysis.
A: Is there a court order that he's violating? If so, you can file for contempt. Otherwise, you can file for custody and an emergency order. More details are necessary to provide a professional analysis of your issue. The best first step is an Initial Consultation with an Attorney.
