Q: My mother and I have a home together she has the mortgage but I am on the deed she now wants to sell and I don't.
Can she make me sell, she hired an attorney and filed some kind of paperwork that I have to answer within twenty day
A: In short. You need to hire an attorney to deal with the legal paperwork. If you are on the deed and she is not typically I would say that she could not force you to sell. However she may have the ability to seek ownership via a constructive trust or some other method. Don't delay. Hire a real estate attorney asap.
A: If you are both on the deed, you would both have to sign at closing to sell the home. She probably filed a partition action, but if she has all of the financial responsibility, being on the mortgage, she may have leverage to make the sale. I would seek legal counsel to respond to the Complaint that has been served on you within the 20 days. Best of Luck! Jennifer
