West Tehama County, CA asked in Criminal Law, Family Law and Civil Litigation for California

Q: Where there is no court order. Is a parent in violation of Penal Code 277. (F, G, H, I, J, K) And Penal Code 278.5 ABC

I also believe that the other parent is in violation of many family law codes, as well as the before mentioned CA PC's.Such as: FL Code #3046. (b) , 3048. (a) & (b). CA PC 277. (f) states; In the absence of a court order, a parent loses his or her right to custody of the child to the other parent if the other parent: (g) "Keeps" or "Withholds" means retains physical possession of a child whether or not the child resists or objects. (i) "Person" includes, but is not limited to, a parent or an agent of a parent. (k) "Abduct" means take, entice away, keep withhold, or conceal. The parent in question has blocked me on all forms of social media. Has changed her cell number, and her home phone number. She has refused ll of my reasonable attempts to exercise my right to assume caretaker responsibilities, and parenting time with our son. I have been in my sons life from day 1. He is 2 1/2 yrs. She conceals him on private property, and threatens I'll never see him again

A: Reread the code section. It answers your question. If you think you can wade through all the procedural morass, don't hire a lawyer. Start by calling your local court's family law coordinator and see if you can get some free help. Otherwise, expect a large legal bill.

A: My recommendation is that you get court orders regarding custody and visitation and stop doing your own legal research.
