Q: Can I get an restraining order on my sons father in a different county from our custody order?
We share joint legal custody and I have primary physical custody. This is his 8th time attacking me over the course of almost 5 years along with 2 sexually assults resulting in the birth of our son. I have a police report from the most recent one and have 2-3 others from different times. I tried to get a restraining order 2years ago...providing photos of both me and our son after he attacked us but in his county not knowing his parent are friends with lawyers, judges and police officers. I was denied & he was told to be nice to me. We have a current custody order in place in his county but he never follows the order. The times I called it in it just made everything worst and mostly effected our son.
A: You can report this to the police and file for a restraining order. This may also impact his custody rights if you file for a modification in court.
