Q: I was trapped in an elevator for three hours, the emergency phone number was not answered, and the alarm did not work

Is there a case here for any damages?

A: Not unless you can show that this terrible inconvenience has some measure of damage that you can prove.

A: You only get damages for what actually happened. And Pennsylvania courts are not eager to see mental distress cases and you have to show many things for those claims. You can report the elevator & it's problems to the relevant authorities but that's about it.

A: For the three hours--a jury might give you $30--but first you would have to show that the people who owned the elevator knew or should have known of the fault but if it was inspected on an annual basis and they had no way of knowing no fault, then you get to Mr. Kreisman's poing.
