Q: will I be in trouble if I had permission to leave Ca in family court and after I left he had filed an ex parte order?
We have joint legal custody but I have 100% physical custody and he is on parole in California and now because he's on parole I feel I'm forced to stay in California. Even if I'm in financial hardship. I was forced out of our home due to a flood and couldn't make it on my own while he was in jail for domestic violence he came out and moved back to our home. My kids and I were forced out. Since he's on parole he refused to sell it. He failed paying child support and stated he was going to have us evicted from where we lived because he was on my lease as a non occupant he text me he was going to tell the landlord to evict us. He violated his parole by coming into my home he was not taking occupy. I was terrified and did not have anywhere I could go to live with my children except Florida where my family is.
A: File a Request for Order for a move-away order and to modify the legal custody order so that you have 100% legal and physical custody.
