Q: With the recent hurricane, how does that affect my lease? The apartment had no shutters; I am expecting a lot of damage?
Can we just salvage what we can and then just leave? Or what is the responsibility of the owner to fix our apartment to make it livable?
A: Per Florida Statute, Section 83.63, if there is a total loss, you can terminate the Lease and vacate the premises. If a part of the premises is unusable, you would be entitled to a credit for the unusable part. You may also want to review your Lease Agreement for any provisions relating to this topic.
