Sacramento, CA asked in Family Law, Child Custody and Domestic Violence for California

Q: My brother and I ran away from home to live with our dad. Can we be forced to go back to live with my mom?

Our mom is prone to angry fits and expresses her anger through screaming, slapping and punching. She has kept our dad from seeing us and lies when he calls, saying he never does. My brother and I packed our bags and left. Can we still be taken back and forced to live with her? My dad did not know we were coming but he let us in to stay with him. My mom called the police and is telling them things that aren't true about my dad, which they will find out if they investigate. Can the police do anything if neither of them have filed for custody? And can the police arrest my dad for not bringing us back to my mom's house? I am 14 and my brother is 13.

A: 14 and 13 is very young to be making a decision on your own.

courts look at those ages as being unable to make decisions for yourself.

your dad should probably file papers for custody....but does he want it?

are they in same county?

because your mom yells does not mean she does not love you.............maybe she needs Prozac or something like that to mellow her out.
