Q: Can I sue my siblings to force dissolution of an LLC we are in and sell our farm we inherited?
There is four of us and they wanted to keep it for a few years and see how things went. If after that period we wanted to sell then we would. We formed an LLC and rent the farm out to a farmer for crop rent. The oldest sister and my brother who are next in age are the managers of the LLC. After five years we are only seeing about a 2.5 to 3.5 percent return based on expected sell price if we sold it. The mangers can do pretty much anything except take out a loan against the Farm per the LLC. The LLC is for thirty years. The none of the siblings except me want to sell. I am losing money because it is tax free and could be invested in the market. They don’t want to buy me out because the would have to take out a loan and then they would not get much money each year from crop money. I won’t be able to get near what’s it’s worth by selling a fourth of an LLC with the other 3 being family members. Can I sue the for dissolution of the LLC and forced sell of the farm?
