Graham, WA asked in Car Accidents and Traffic Tickets for Washington

Q: How does a person have a driving record amended? Court says our son was not at fault but still shows on driving record.

Our son was uninsured when he drove his vehicle and was hit by a commercial van April 2017. The police report says it wasn't his fault, and the driver of the van stated at the scene it was *his* fault. The police report states our son is V2 and V1 was at fault. Our son received a citation in the mail for "failure to appear" yet had not been given a summons to appear. He went to court and the judge said he could see that he was clearly not at fault, per the police report. However, our son's driving record does not reflect this, showing he was at fault for the accident. Due to the this accident, our son lost his first job; has an auto that still needs repair because the adverse party did not pay; and he has now lost his second job since it requires him to drive a company van for appliance repair calls. His company can't let him drive because of this wrong record. He has been given 2 weeks' notice at work and we hope this can get solved quick. Thank you for your help.

A: First get court records, contact dmv see what you can do.

Second if that doesn't work contact your state legislators.

If he was hurt in the crash, contact a member of the State of Washington Trial Lawyers Assn--they give free consults.
