Mchenry, IL asked in Child Support and Divorce for Illinois

Q: Where can I find pro bono divorce (legal separation) layer? Can I file a legal separation while I am outside of USA?

I want to do this process peacefully with my husband. Do I still go to court if I want to file a legal separation? I am planning to go back to Japan where I am from with my two children. My husband agrees with me to take the children. I Because I will not have a job lined up when I get home, I would like to have my husband pay for child support and spouse maintenance. Can I file a legal separation after I leave the US?

A: Yes, if you file here before you leave. You must have lived in IL for 90 days prior to filing, and you must be willing to come back here for your court date.
