Laurinburg, NC asked in Child Custody, Child Support and Family Law for North Carolina

Q: If my boyfriend agreed not to pursue child support against his sons mother in the custody order will he held contempt?

My boyfriend wants to pursue child support on his sons mother, she has every other weekend. She does not pay daycare no contribute to the child. Her parents have every other week visitation on Wed and Thurs when it's not her weekend and they also are required to pay 150 (half for the month) of the child's daycare. However, daycare had recently increased. Will my boyfriend be held contempt if he decides to take out child support on her anyways even if he agreed to not to in the custody order/agreement? His lawyer at the time told him not to worry about it if he wanted to take it out in the future it will be okay and that no judge would allow that because it is not his choice, and advised him to wait until after his son is done with daycare. However he really is struggling and needs help.
