Lakeland, FL asked in Car Accidents for Florida

Q: My son was in an accident where the "at fault" left the scene. My Insurance is not pursuing, how can we pursue this?

We did not have Comp and Collision on the vehicle. The man stopped, realized he lost the load he was carrying, which damaged the vehicle, did not check if anyone was injured, and left the scene. His tag number was reported to the State Trooper's Office, so there is an address and phone number. Insurance company contacted him, he is avoiding all calls and letters. He should not be able to get avoid the consequences, just because he avoids answering calls. How do I find out his Insurance Company or file charges against him?

A: Your situation seems very strange. Typically law enforcement will pursue someone for leaving the scene of an accident. You can hire a private investigator to run his tag number, which will give you an address. Then you can file a case for damages against him. I suggest that you hire a lawyer to assist you in doing all these steps correctly. You can use the Justia find a lawyer feature to locate an attorney in your area. I am not close to you so it would not be feasible for me to help.

A: Ask the cops who presumably took a report if they can give you the insurance information. Or file a statement with the dmv requesting the same. If you were hurt contact a member of the Fla Justice Assn--they give free consults.
