Q: If a parent has had no contact with a child for 6-7 years how easy is it to get rights terminated to be able to adopt?

My stepdaughters mom has had no contact with her since she was around 8-9. She is now 15. The mom has also been in and out of jail for drugs and other things since then. How easy would it be for her rights to get terminated so that I could adopt her? She has never tried to see her daughter since then. Her dad (my husband) has had full custody this whole time.

A: You may be able to adopt without consent of mother if you meet the legal standard. See an attorney to learn if you qualify.

A: Yes you will be able to adopt. It's a two step process.

First, an action for termination of her parental rights must be filed. This can be avoided if bio mom is willing to appear before a judge, and consent to the adoption.

Second, file the Petition for Adoption. You should consult an experienced Family Law Attorney, in your area, for help with this problem.
