A: Yes. If you want to record a court proceeding you need the Courts permission.
A: Yes they can. You are in court and it is up to the judge. Get permission of do not do it. You can hire a court reporter to take a record and get your record if the proceeding. The court reporter record is absolutely allowed but just taping is up to the judge.
