Morehead City, NC asked in Divorce, Child Custody, Child Support and Domestic Violence for North Carolina

Q: I was served in NC with a DVPO that is full of false accusations. What can I do?

*I have added additional information to the bottom of this form *

This order was served after she began manipulation and gaslighting in order to make me jump through hoops to get time with my son ( we are separated) The order claims violence, threats and many other claims that are not true. Im a recovered drug user and she also mentioned drugs on the order. On top of the aforementioned, she called 911 and stated I refused to leave after visiting my son last week which was not true. She added him to the order and that is what bothers me. I don't care to contact her at all unless it regards setting up time to see my son I fear that if she is awarded the order I won't be able to see me son.

I feel, according to the definition of Domestic Violence in NC, I was a victim due to the emotional distress caused by the hoops I had to jump through to see my son. And even more so distressed by what this order can do to my livelihood and ability to be a father to my son.Is my position on invalid

A: If you can not afford an attorney your options are to go to court, do the best you can and let the chips fall where they may. If you lose, you likely won't get to see your son. And yes, it is very possible you got played.
