Q: I have a misdemeanor, carrying a concealed in 2012. The charges are in Bolivia, NC. I wanted to get my record expunged.

I would like to find out the process to get my record expunged after the new law for expungement starts. Also do I have to hire a lawyer from the county the charge occurred?

A: It is recommended to contact an attorney in the county where you were charged, but it is not mandatory. This is because that attorney would have to file your expungement at the clerk's office in the county where you were charged. It also isn't clear from your question if you were convicted or not; if you were convicted, the new law holds that 5 years have to have passed from the end of your sentence on that misdemeanor. For example, if you were convicted and sentenced to 12 months probation, you'd have to wait to expunge until 5 years had passed from the end of your probation.
