Hampton, VA asked in Business Law, Consumer Law and Small Claims for Virginia

Q: I am dealing with a company that I believe is/was false advertising. If I explain more could anyone help?

The company had lots of Black Friday incentives to earn prizes or codes that the company advertised as being able to be used on the promotions that would be offered during Black Friday. I have a screenshot of me winning the game that was titled The Black Friday Dragon Slayer and a printed coupon with the 50% off promo code. On both of these items it does not state that it cannot be used on specific items. However when I went to go shopping at 3am it would not let me use the coupon that was advertised with Black Friday sales. I emailed customer service first and they gave me the run around, then I did a live chat with a agent who led me to believe it was a glitch and who contacted technical customer support, and now there is an official ticket filed on the website and we are still disputing. They tell me now items on "flash sale" could not be used with a coupon and tried to give me $2.00 and now $2.50 as a "I am sorry gift."

A: The Virginia Consumer Protection law is a false advertising law. It gives you the right to triple your money back PLUS legal fees. You can read more about that law, here. https://law.lis.virginia.gov/vacodepopularnames/virginia-consumer-protection-act/.

One place to look for lawyers who do that kind of work is the National Association of Consumer Advocates, here. http://www.consumeradvocates.org/find-an-attorney
