Should be hired a probate or real state lawyer we want to transfer the title of the house and we also need to named an executor because he has a debt on cc
A: If you and your brother are the only heirs, definitely DO NOT do an estate proceeding if there is no other asset than the house. Do not pay the credit card. If you both consent as to what should happen, you can do a deed transfer as heirs at law without any estate proceeding. Just keep paying the mortgage. I would charge $800 for the deed, including recording fees.
