Chicago, IL asked in Divorce and Child Support for Illinois

Q: petition for diss of marr denied by Judge spouse didn’t show up to court. Are previous orders no longer valid?

I filed in 2012, have custody of minor child. 5 years later after going through 3 judges, I was ordered to pay spouse 32k by Judge Bowes after original judge Logue takes a leave after not ruling on my motion for 9 months. Judge Bowes sets trial date and transfers to 3rd Judge. Neither spouse nor spouses attorney show up for trial date and 3rd Judge denies my petition for dissolution of marriage and states case is no longer on the call. My only question is this....are any previous orders by Judge Logue or Judge Bowes still enforceable Or is it as if nothing ever happened since my petition was denied and the judge said my case is no longer on the call and there is no final ruling? I’ve been told it’s like nothing ever existed and I have to start over. I’m looking to verify.

A: You say you both had lawyers who didn't show up for trial.

Had you two reconciled.

Anyway, why not ask your lawyer what the status is because they may still be stuck on the case.

A: Your question is too difficult to answer without knowing more info. However, suffice it to say that taking a case "off call" does not mean that it is dismissed. Within the context of your question, it is only in cases of actual dismissal where the temporary Orders are rendered null and void.
