Orlando, FL asked in Elder Law and Animal / Dog Law for Florida

Q: I have 15 cats share a home with my mother, I’ve partly inherited the home, can she call to remove them pets shots/spays

I think it’s mostly inheritance dispute all pets shots/spay/neuter regular vet visits rabies papers, she continues to threaten to call animal control citing “health issues” unsanitary conditions it’s her home, my dad passed in 2014, she won’t part with the money 4 years later, but wants me there to assist her in all her daily needs, she let my cat out while I was at work she came back pregnant had 8 more kittens before I was able to spay her (waiting for her to wean the other 3 kittens I was rehoming) now the threats are daily, to me this is retaliation, I’ve been in this home one and off since 1997, relocated back from out of state to care for my dad in 2009, he passed in 2014. The stress/daily fights are making me depressed, my work was affected by hurricanes, lost both jobs 10 years of work. House isn’t dirty. What can I do? She won’t pass on my inheritance so I can move back out of state but controls/terrorizes me with daily threats to throw them out or call to have them removed?

A: Very sorry for your situation. I am not sure that there is a legal answer to her threats. You state briefly that you have an inheritance dispute.

I suggest that you consult with a probate attorney in your area to determine what if anything you are entitled to from your Dad's estate, then go from there.
