Q: My mom was carjacked, injured and her car is totaled. Should she still have to pay her insurance and car note?
A: Sorry to hear this happened to your mother. I would not see the reason to pay ongoing insurance for a destroyed car. Her insurance will pay off the note, and, if the note is more, her GAP insurance will cover the difference.
A: She doesn't have to pay her insurance, but if she is thinking of getting another she may want to keep it up. As to the note, it would be better if she paid because that way it isn't a late payment on her record. The insurance she has--if she has any--will pay for the note but if the value of the car is less than the payoff on the loan, she will have to pay on the balance. If they catch the thief she can ask for restitution. If she has medical bills she can see if her car insurance will cover any that her health insurance didn't pay for.
