Q: How do I get out of my current lease (IL) without my credit being ding'd and is it possible to keep my security deposit?

I moved to my residence as a renter in Streamwood, IL in August of 2017. Shortly after moving in I had been let go from my job. Since September, I have been struggling to get by. Up until this month (January 2018), I have been jobless. I start a new job on the 3rd of January, however, its is over 50+ miles from where I currently live (Streamwood, IL). I am no longer able to accommodate the $1,400.00 for rent due to my salary decrease, and have no other things to pawn in order to make up for rent. I am looking for legal advice for this matter. PLEASE! I have been struggling to pay my bills for the past 4 months and have FINALLY got a new job! However, to get out of this financial burden, I need to get out of this lease. Please let me know what is best advisable.

A: I strongly disagree with the previous answer. Most residential leases do NOT have a provision saying a party can simply give a written notice and walk away from the lease after a few days.

Better advice: sit down with the landlord and explain what's happened. Ask what he or she can do to help you out. It's best if you have a responsible person lined up to suggest as a subtenant (someone to take over your lease and live in the apartment - though you remain responsible for the rent and other things on the lease if the subtenant fails to meet those obligations).

As for the security deposit, you're unlikely to get any of it back until the term of the lease expires and the landlord inspects for damage.
