Louisville, KY asked in Consumer Law and Contracts for Kentucky

Q: I hired a software company in Colorado to build a new website. I've paid them over$9,000.00, and still no website.

The contract I signed said no refunds, however, they can't finish our site because of the way our business operates, which they should have noticed in January if they had listened to us or at least gone over our current site.

In August 2017 they told us we must change our business model to accommodate their software, which would have put us out of business. So we said no, then they said they would write a additional program for $7,000.00. When I asked the owner to explain exactly how it would work by showing us a mock up of the corrections, he started blaming us because the software wouldn't work. He basically said we were too stupid to use the program and we haven't heard back. Do we have ANY legal rights? They cannot give us what we contracted for, so aren't we entitled to get our money back? They were pretty deceitful when they we're luring us to sign on, or we never would have gone with them. I cannot afford to throw $9,000. Away + the year wasted.
