San Jose, CA asked in Constitutional Law, Libel & Slander and Personal Injury for California

Q: My friend is being sued for personal and emotional injury, can the plaintiff pin his actions on my friend?

Since I posted my last question: https://answers.justia.com/question/2017/12/05/my-friend-was-arrested-for-trespassing-b-356932

The stepfather is kicked out by the wife and she's filing for divorce, fired from the school he worked and arrested.

My friend accused him of bullying, stalking and harassing students. Police looked into it and they found proof that can prove her accusations true. They found photos on students and private student info at his personal computer and former home which is against school policy. Police found proof that my friend is one of his targets. His activities has been going on even before my friend transferred to the school or came in to his life. He blames his problems on my friend and claims she hurt his family, even though she came into "his" family's life and they had great relations until she moved away and he came in to their lives.

A: anyone can sue anyone else at any time for anything............proving it is another matter.

i suspect he is doing this pro per without a lawyer as few lawyers would take it.

your friend needs a lawyer to answer or demurer to the complaint...............

maybe legal aid can be of help.

a lawyer would have to hear all the facts but a judge might dismiss up the filing of a motion............however most would let the case proceed...i think

a lawyer really needs to go over all the facts
