Q: I lost custody of my son to the state of Nebraska, my son was placed with his bio. Neb nor Florida have custody, can I

My husband is the legal father on the child's birth certificate signed by a Florida judge. I'm trying to figure out if I can take my son being that no custody was sought out by the bio through Florida or Nebraska. Nebraska no longer holds jurisdiction of the child.

A: Your legal problems with this son are just too complicated to give you a good answer without knowing more about the facts. But this much I'm pretty sure about. If the custody was placed with the "Bio Dad" was there a paternity DNA test establishing Bio was in fact dad? If so, the Florida Birth Certificate for your husband is now void. Also, since there is a court order for custody in place, you can't just take the child. You will need to hire an attorney where the child now lives to file for custody.
