Q: Under the new Illinois child support law what if my ex who has my daughter more in parenting plan refuse to work but can
I have my daughter 143 overnights my ex husband got mad at current employeer and stormed out of his job. Since he is more than capable of having a job will this go into play. I feel as if he only wants her to get money out of me like when we were married.
A: As a general rule, the courts will impute income to a parent who manipulates the system to reduce or eliminate their income. In other words, if the ex was making $500 per week and quits his job without a valid reason, the courts will treat him as if he continues to make $500 per week when calculating child support.
