Q: I got my sons a phone and my mother who has Guardianship of my sons will not allow my sons to have their phone.

She says she will do whatever she wants with the phone. Can I report her for taking my sons property?

A: You should consult an experienced Family Law Attorney, in your area, for help with this problem and to review the guardianship file. You may want to file an application with the court to permit the phone, or at least permit you to better communicate with him. A lot depends on the age of your son.

A: A guardian of a child has the same rights as a parent. So, the guardians do have the right to prevent a child from having a phone. You should talk to them, and see if this can be voluntarily worked out. Do they let you talk to your sons when you call? If there is not a court order regarding your contact with your kids, you should hire a lawyer to help you with this.
