Q: In accident w/ old lady who was at fault and only had pip. Can I go after her house. Its all she has.

A little old lady pulled out in front of me and was at fault when I ran into her. All she had was personal injury protection insurance. The damages and medical bills for exceeded that. All she has in the world is her house. Am I able to go after that, I was told that that was Untouchable am I correct?

A: Most likely no. A persons homestead is a protected assets from judgments other than mortgages obtained to purchase or renovate.

A: First she would have 10,000 min in liaiblity (PIP) & 10,000 property damage (min). She may have more. Going after a house wouldn't be a likely source as she could, even if the law allow, file bankruptcy as a blocking move. Suggest you contact a member of the Fla.
