Liberty, NY asked in Employment Discrimination and Employment Law for New York

Q: I'm working at a job where my one boss doesn't like me and wants me gone. Tried to make me signed a document that's not

It's not true, I've. Been working there for a year and a half. This boss curses and is really rude. I tried to explain the incidents and what truly occurred but they didn't want to hear it. I think they are trying to do is not pay me unemployment and fire me. What should I do?

A: Never quit. Never violate company policy or rules. If they tell you to do or not do something follow orders.

Look for a new job - fast. Get one before they fire you.

No union, no government, no contract you are "at will." They can fire you for a good reason, a bad reason, or no reason at all.

You have not stated any facts that you are being discriminated. Treating everyone rudely is not illegal. Of course if the rude language includes racial, sexist, gender phobic, or other types of comments that's a different story. But your facts have none of that. Workplace rules or policies are not a civility code. That's almost a quote from the United States Supreme Court. If you want unemployment you "should" be awarded benefits (remember the Department of Labor and not your employer decides whether you receive benefits - even if your employer wanted you to receive benefits but the DOL confirmed that you violated some policy you knew could get you fired you will not recover unemployment) so long as you do not quit, you try your best, and you do not disobey requests on the job or do something that you have been warned not to do. Good luck.
