Melrose Park, IL asked in Family Law, Child Custody and Child Support for Illinois

Q: my child's father on child support and it says he is not the custodial parent is that good enough to get a passport?

At a court for child support I asked if I had full costudy and they said yes. But I plan on moving out of state and going out of country for vacation is just the child support saying he is not the custodial parent good enough or is there something else to be done? I also have a message of him saying if I drop the child support he will sign over all his rights does that help?

A: You do not have the right to drop child support if he will sign over his rights. In the first place, the child support isn't for you, it's for your child. In the second place, a child isn't like a lamp where once you pay a certain price (in this case, waiving child 'support) it belongs to you.

As a general rule you cannot move out of state with the child without the permission of the other parent or the court. In either case there are numerous steps to follow and loops to jump through.
