Asked in Products Liability and Education Law

Q: Hello !! My son's school confiscated his vapes and they are refusing to return them to me. Ever !! Is this legal ?

The school policy is they don't allow them on their property. I understand that. I also know that those vapes don't belong to them and I believe what they are doing is wrong. They don't have the authority to dispose of them, as they told me they were going to do. When you confiscate someone's belongings it is the intent to return it some time later, not keeping it forever . They might as well call it stealing.

A: Get them to put in writing why they refuse to turn it over to you. That alone may make them back down. Realize also they can give your son a hard time and is this what you want to put your marker down for? And what message does it send to your son that you want to recover prohibited items he brought to school? Maybe he'd learn a better lesson if he lost them. https://www.theguardian.com/science/2018/jan/29/vaping-may-raise-cancer-and-heart-disease-risk-study-suggests
