Q: Hs officer cites minor w poss of tobacco device having not witnessed, on word of teacher ?

Was handed this device in a hs bathroom ,immediately before trying to use the toilet ,during a panic that a teacher was en route, hence being caught. This student , who does not vape, is not a vaper, and has never vaped, was then setup by the teachers, hs officer, and vice principal- by asking “how to turn the device off” student initially replied he doesn’t know, and per the vice principal, then explained how to do it- and that alone confirmed guilt . Apparently enough for the vp to assign a $30 tobacco class and enough for the hs officer to issue a $30 citation- I understand this is all minimal and trivial- but right is right and wrong is wrong- is there a case here

The only case at this point is the one being claimed by the officer. You can likely challenge the officers case. Most likely the schools guidelines allow for some type of challenge.
