Brooklyn, NY asked in Foreclosure and Real Estate Law for New York

Q: Can I stop a Grievance Committee complaint?

I filed a complaint with the Grievance Committe against a real estate attorney for breach of contract. He returned my retainer fee in its entirety but responded to my original complaint. It was full of lied but I let it go since I had my money returned. He wrote a second rebuttal and I vehemently responded with over 30 emails proving his lies. He informed me through a mutual contact person that he's in jeopardy of losing his license and asked if I could rescind the complaint. Will the Committe allow me to rescind my complaint even though they have evidence of his misconduct?

A: While saying that you are satisfied with a settlement with the attorney and do not want to pursue the complaint, the Committee determines what cases to handle. It is like when the victim wants to drop a criminal complaint. The DA does not have to do it.
