Edmonds, WA asked in Immigration Law for Washington

Q: Hi whould a charge of 4 degree assault affect my eligibility to receive Green Card based on marriage?

I have been charged with assult with sexual motivation, a Grosse Misdiminore. I was planing to go to trial to get it dismissed but my attorney advice to not to because he said that I'm not citizen and that the judgement will not be for my favor even that the clam aginest me is so weak and has no support to it. So he adviced to get a deal with the court to continue the case for 1 year with paying 300$ fine and doing 40hours community services and at the end of the one year the case will be tottaly dismissed. Do you thing this will affect my eligibility to recive a green card based on marrige? What is the worst scenario that could happen at the interview? One more point is that my interview date is 23 days before my case dismissal hearing. Will that be an issue as well?

A: The worst case scenario is that your application could be denied, and you could be placed in removal proceedings. You really need to speak with an immigration attorney who is familiar with criminal laws that cover the area where you live.
