Q: if I move to California will my child support change to where I have to pay more? Based on guidelines.
Ex wife and I have a decree where we agreed I'd only pay $300 a month because she owes me back child support from when I had him for a year. I’m moving to California with my new fiancé and all of a sudden ex wife wants to go by the guidelines. My question is, will I have to pay more because minimum wage is higher there? The cost of living is also higher there and that’s my worry. She also just got a new car last week and told my son not to tell me. She’s married now, has another child with her husband and she doesn’t work because she’s going to school. She’s using the fact that she doesn’t work against me and saying I’ll have to pay for daycare as well just because she doesn’t work. Our son is in school I don’t understand why she can’t go to school at the same time as him. She also wants me to give her full and sole custody instead of having it joined like we have it on the decree. I recently lost my job and am behind on child support.
A:
You should consult an experienced Family Law Attorney, in your area, for help with this problem. Under the law, you must give her written notice of your proposed move, and more details. This requirement should be in your decree. If not, check 43 Oklahoma Statutes § 112.3.
Your support will still be calculated under Oklahoma guidelines. Ex's income will be what she's capable of earning. Good luck.
