Newark, NJ asked in Divorce, Family Law and Child Custody for New Jersey

Q: My ex wife leaving on vacation and said she would leave 6 year old daughter with a friend if I can't take care of her.

We have joint custody. If I can't take care of her then can I object her leaving her with a friend.

A: Thank you for your question. I know how worried you must be about who will care for your daughter while her mother is on vacation.

The short answer is possibly. Specifically, more information is needed. Do you and your ex-wife mother share joint legal custody of your daughter? What is the basis for objecting to her mother’s friend caring for your daughter when her mother goes on vacation? Do you have relatives who can care for your daughter in her mother’s absence? Does the custody and parenting time order provide for the “right of first refusal” when either parent is unable to care for your daughter? Are there safety concerns for your daughter if she is left with her mother’s friend? It is important to protect your interests and have an experienced family law lawyer advocate for your interests . An experienced family law attorney will help ensure that your rights are protected and make sure that your daughter is in a safe, stable, and loving environment at all times.
