Q: In Car Accident In Rental Car No Insurance

Hi I have a question. I was a car accident in a rental car I rented for spring break. My mom paid for CDW coverage, but it liability. I was seriously injured. But I had no liability. Would I have my license suspended? I'm in California BTW.

A: Driving without insurance in California is a violation of California Vehicle Code Section 16020–16033.

First offense: Minimum fine of $100. Additional fees and penalty assessments will result in a total fine of about $450.

Second or subsequent offenses can result in fines totaling between $900 and $2,500.

Potential impound of your vehicle.

Potential suspension of your driver's license.

Also, you may have a personal injury claim. If you are driving without liability insurance, you won't be able to recover pain and suffering, but can recover past and future medical expenses, past and future wage loss, and property damage. You might be covered under your mother's liability policy, if any. Consult with a PI attorney quickly and don't talk to the insurer for the other party.

A: if you are uninsured your license will be taken away............but first check with car your insurance man.....if you had a car on which you were insured you might be able to collect under UM...........do you have that?

A: If you were not at fault contact CAOC--they give free consults. Depending on your mom's insurance and if you have coverage you may be covered for this though you must look at the policy language. If you don't have insurance you need to apply to MediCal asap to assure coverage of bills.
