Q: I suspect my ex girlfriend is charging me with DV. I never touched her however. She caused a scene and police arrived.

I waited for my ex outside her home recently in efforts to retrieve property she had taken from me. I have no means of communication with her other then messenger but she had blocked me, so I decided to wait outside her home and confront her. She willingly walked to my car where We spoke. I said some things she disliked. She then escalated and began to cause scene, yelling and screaming, she bag punching my asked to leave me car but she continued to yell and scream. She was able to grab a watch and run off with it. I briefly pursued as she continued to become hysterical. I decided it was better take it as loss so I had left the premises before police arrived. Two days later I was contacted by a detective, stating I was a suspect in an investigation over events that had occured. He didn't state domestic violence. He said events. But I dont what other charges she could bring. I dont hurt her. We just had an argument and she escalated. Should I be concerned and seek legal representation.

A: DV is the hot new crime being charged as a criminal offense. You absolutely do NOT want to talk to the detective without legal representation. Your Miranda rights to remain silent are useless if you don't exercise that right...but not 1 on 1 with law enforcement who will take that as an admission of guilt. If you do decide to speak to them alone, remember the old adage, "anything you say can be used against you in a court of law" and LEO's (Law Enforcement Officers) are trained to elicit confessions from suspects and under the law can lie (like they have witnesses who saw you allegedly hit her) in order to trick you.

Hire the best criminal defense lawyer you can afford to head off charges BEFORE they're filed.

it is not up to her as to whether charges are filed.........the police in investigate and the DA decides based on the facts to decide what charges should be filed.

the victim is the people of the State of Calif.

you should contact a good criminal lawyer in your area. If you talk anything you say can be used against you. It is not always what you say but what the police thought they heard you say.
