El Cerrito, CA asked in Criminal Law, Federal Crimes and Domestic Violence for California

Q: I was charged with dv for throwing a plastic container with ranch towards my bf face. He was bleeding & called cops.

Cops came & arrested me right away. He was bleeding from the outside of his nose. They recorded the injuries. But then the next days he said he didn’t want to put charges on me & he bailed me out with $3,500. We are on good terms now & still live together but I have court on May 14, 2018. What would happen? It’s my first time getting arrested he had called before but it was just because we had a big argument.

A: You should have your lawyer explain the facts to the DA....either an appointed or retained lawyer...

You committed the act but he does not want to prosecute.

HOWEVER, the Victim is the people of the State of California. It is not up to you to press charges. If a crime is committed they pursue it.
