Q: What do I do when the police report is unable to determine fault for a car wreck?

The police were unable to reach the witness, but my insurance company got a hold of her and her testimony corroborates with mine. The police report also claims I said "I didn't see him", but I NEVER said anything of the sort and the drawing on the crash report is incorrect too. The police took approx 25 min to show up to the seen and I was having a panic attack. There was also construction on the side lanes of the roads and the police report insinuates it's the construction co. that was a major player in the wreck. Can I sue the construction co. for the damages to my vehicle? The adjuster came by to look at my car and said if the other drivers insurance takes liability, then the car would be deemed totaled. Any help is appreciated.

A: If you were hurt in the wreck call a member of the Texas Trial Lawyers association. Police reports aren't dispositive. Some are bad, some are just odd. Depending on who was where, who had the right of way,what the property damage shows can all make a difference. I've had cases where my client seemed at fault and I was able to recover. If you have collision run it through your company and let them go after the other driver.

Their having a witness support you is very good.

You should check and see immediately if there were cameras at the intersection.
